Limitation of liability and warranty disclaimers

The services are provided “as is,” with all faults. To the extent permitted by law, PapaProxy.net and its affiliates, contractors, and partners (collectively, the “Released Parties”) hereby disclaim all warranties, express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. You assume all risk in connection with your use of the services and with respect to their quality and performance, including, without limitation, the risk of deletion of or damage to your software, hardware, or content, unauthorized access to your information, and misuse or misappropriation of your data by other users. This limitation applies even where any remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of implied warranties, so this disclaimer may not apply to you.

Except as required by law, the Released Parties shall not be liable for any direct, indirect, special, or consequential damages arising out of or in connection with the Terms of Use or the use of the services, including, without limitation, damages from loss of reputation, loss of profits, loss of data, or computer failure or malfunction, even if the possibility of such damages was known in advance, and regardless of the theory of liability (contract, tort, or otherwise) on which the claim is based. The aggregate liability of the Released Parties under this Agreement shall not exceed $500 (five hundred US dollars). Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

You agree to defend, indemnify, and hold harmless PapaProxy.net, its contractors, employees, and partners, and their respective directors, officers, employees, and agents from and against any third-party claims and costs (including legal fees) arising out of your use of the services, including, without limitation, your data or your violation of any of these terms.
