To the extent permitted by law, "papaproxy.net" and parties exempted from liability hereby disclaim all warranties, explicit or implied ones, including non-defect warranties, merchantability, fitness for a particular purpose, or non-infringement of third party rights without limitation. You assume all risk in connection with use of communications for your purposes and with respect to the quality and communication performance including the risk of removal or damage to your software, hardware or content, or unauthorized access by unauthorized persons to your information, and misuse or misappropriation of your submission by other users without limitation. This restriction applies in situations where there is no significant application of any remedy. Some jurisdictions do not allow the exception or limitation of implied warranties so this disclaimer may not be applied to you.
Except the cases as required by law, "papaproxy.net" and parties exempted from liability shall not be liable for any direct, indirect, special or consequential damages incurred due to or in any connection with these terms of use or the inability to use communications, including, without limitation, direct and indirect damages due to loss of reputation, loss of profits, loss of data and failure or computer malfunction, even if the possibility of such damages was known from the beginning, and regardless of the theory (contract, tort or other) on which claim is based the aggregate liability of "papaproxy.net" and the parties released from liability under this agreement does not exceed $500 (five hundred dollars). Some jurisdictions do not allow exclusion or limitation of incidental or consequential damages so the above limitation may not applied to you.
You agree to defend, indemnify and protect papaproxy.net, its contractors, employees, partners and their respective directors, officers, employees and agents, from and against any third parties and costs (including legal fees) arising out of your use of our Communications (including your filing or your violation of any of these Terms without limitation).
